Times New Roman>; mso-hansi-font-family: >Times New Roman>\">一、陈淑萍同志1977Times New Roman>; mso-hansi-font-family: >Times New Roman>\">年在出差时受伤的工伤认定问题，根据《劳保条例实施细则修正草案》第十一条规定，应由单位工会劳动保险委员会审查确定，所以当年省劳动局的处理意见是有法可依的。
Times New Roman>; mso-hansi-font-family: >Times New Roman>\">二、根据国务院《工伤保险条例》第十七条、第六十四条规定，对于陈淑萍同志主张历史上的伤害事故为工伤的，我厅不再受理其工伤认定申请。
Times New Roman>; mso-hansi-font-family: >Times New Roman>\">三、工伤职工旧伤复发时，仍与原负工伤责任的单位保持劳动关系的可以享受工伤医疗待遇；其他的可由你单位在“自主权”范围内自行考虑解决办法。
